  1. The Kelp Gull is not likely to be the rignt species, because it is spread in the southern hemisphere. There are several other species in the New York area, but it is not possible to identify it from this photo.

The Kelp Gull, also known as the Dominican Gull, breeds on coasts and islands through much of the southern hemisphere.
